國外如何因應大法官缺額可能造成裁判正當性不足的問題？如何規範表決數？民間司改會擔心，國民黨立委翁曉玲的修法草案將片面停止憲法法庭，衝擊人民基本權利保障與對行政權的制衡，並將升高立法與司法的對立。
目前有三個法律修正案要被強行通過

憲法法庭停止運作，對於人民基本權利的保障、政府機關間的權力制衡，都會有衝擊。大法官作為人權保障最後的守護者，在司法制度上扮演重要的功能。憲法法庭除了限制立法權之外，更重要的是對於行政權的限制。若憲法法庭停擺，將同樣使得總統、行政權失其制肘。如立法權及其他權力機關未能尊重司法權，導致違憲、違法的行動淪為司空見慣，將嚴重侵害台灣得來不易的民主及法治基石。司法改革的目標，從來不是徹底摧毀司法的公信力，然後令其停擺；而是如何透過改革，獲得一個更值得人民信賴的司法。
