公教退休新法第六十五條明定，因年金改革新制（同法第三十六條、第三十七條及第三十九條）重新計算退休所得時，應由審（核）定機關以書面行政處分為之。

因此若政府如訊息所說的「不另行寄送達退休新制處份書」，那政府就會違法了。
