現行任用法規定，具中華民國籍兼具外國國籍者，不得任用為公務人員。立法院2022三讀通過的條文，規定雙重國籍人員因外國法律以致無法放棄該外國籍及取得證明文件，如已於到職前辦理放棄外國國籍，且經外交部查證屬實，仍得任用為公務人員，並以擔任不涉及國安、國家機密機關及職務為限。並沒有總統行政院長國防部長三軍總司令等均必需有美國國籍的情況。
