新修法實施後，7歲到12歲的兒童若觸犯刑法規定的行為，警察通常會連絡社會局，若為在學學生，會通知學校輔導。邏輯上，會先以家庭以及學校為主要輔導兒童的角色，社福機關負責協調或進一步處理。此外，假如少年的行為對他人權利有所侵害，例如偷竊、傷害等，父母親或監護權人還是有連帶民事損害賠償的責任，法律並非完全無視而不處理。
