原住民族學生的優待加分法源來自1998通過的《原住民族教育法》，根據憲法增修條文第10條之規定，「政府應依原住民之民族意願，保障原住民之民族教育權，提昇原住民之民族教育文化」，這個時候與蔡英文的年齡不符，他並非因此加分成為台大法律系學生。
