台灣沒有像日本一樣加班換補休必須先經集體的協商程序訂成團體協定,也沒有像其他一般的制度至少有工會要工會同意,無工會者要勞資會議同意。32條之1只規定由勞雇協商,因此雇主可以一對一與勞工協商,絕大部分勞工完全沒有協商能力。
