所謂的駕駛，就是讓交通工具可以在路上移動的行為，即便引擎沒有啟動，只要有轉動方向盤或是煞車，就構成駕駛行為。像是下坡時關閉引擎滑行，或是駕駛中熄火讓車子慣性移動，雖然沒有啟動引擎但仍可操控移動車輛，這就算是駕駛。假如這個時候有喝酒、被酒精影響，就算酒駕。（參考新北地院105年交字386號行政判決與高等法院105年交上易字第288號、台中高等法院98年交上易字第161號刑事判決）
