，新北市長侯友宜指出，疫情爆發以來，24小時火化確診死者，本就是常規流程；台北市長柯文哲則表示，由於醫院存放大體空間有限，加上病毒傳染風險，SOP下，24小時內火化，為合理處置方式。新冠肺炎被劃定為《傳染病防治法》中的「第五類法定傳染病」。「第五類法定傳染病」的框架下，新冠肺炎被視作「新興傳染病」，且具有高度未知性。根據《傳染病防治法》規定，絕大部分被定義為「第五類傳染疾病」的新興傳染病確診死者，都必須要在24小時內入殮並火化，其中更包括伊波拉病毒、黃熱病、MERS等。
