未經合法程序逕為搭建太陽能光電設施，或設置後不從事農業經營，即非屬作農業使用，都會被改課徵地價稅。農地種電要免稅，一定要符合合法「農業設施容許使用」、「綠能設施」和「農地農用」3要件。在農地上興建任何設施前，最好事先詢問農業、地政及建管單位，以免造成農地違規使用而被改課徵地價稅，或移轉時被課徵土地增值稅而影響權益。
