軍公教人員主管加給列為免稅範圍是來自於所得稅法第4條第五款明定：公、教、軍、警人員及勞工所領政府發給之特支費、實物配給或其代金及房租津貼。公營機構服務人員所領單一薪俸中，包括相當於實物配給及房租津貼部分。上述規定由財政部主管，所定政府發的特支費含主管加給，其適用對象公、教、軍、警人員及勞工。
