並非「年滿18即可參選」，該修正案第一項還有後半段規定，即「除憲法及法律別有規定，年滿18歲者，亦有被選舉權。」若有其他關於被選舉人資格（年齡、學經歷等）規定的話，應依其規定辦理，例如憲法明定總統候選人要滿40歲，這其實是憲法對法律的委任；也就是說，除非立法院未在相關選舉法令中規範「候選人的年齡」，18歲的年輕人才會在修憲後，取得被選舉權而成為候選人。
